Booking Terms & Conditions

General

Please ensure that you have read these terms and conditions prior to booking. By booking or attending a swim session with us, you accept these terms and conditions and they will form part of the contract between us. Medical

Swimming open water can be physically demanding and you are aware of the associated medical and physical risks involved. You accept that you are physically capable of competing in the regular swims and events and agree that, subject to the limitation of liability paragraph below, Attitude Swim Coaching Ltd, its directors, coaches, staff and volunteers are not responsible for any injury or illness that you may suffer as a result of your participation. The entrant accepts that should any medical or physical condition arise which is likely to affect their ability to compete then the entrant will withdraw in accordance with these terms and conditions.

You will inform us of any medical conditions from which you suffer. You give permission to our staff and medical support to make decisions regarding your medical care and treatment and, where necessary, to authorise such care and treatment in emergency situations. You understand that our staff will make every reasonable effort to reach your emergency medical contact that you have supplied, however you hereby give permission to the medical professional whose services might be required to provide medical care and treatment.

Safety and general rules

Swimmers are responsible for their safety, actions and behaviour on any part of the site property including the jetty area. Safety for all is our paramount concern and we have the right to remove anyone on, in or around the site who gives us any concern whatsoever with regard to safety. If you choose not to wear a wetsuit then you enter the water entirely at your own risk and we shall not be liable for any accidents or injuries you sustain.

 

 

Limitations of Liability

Whilst every reasonable precaution is taken by us to ensure security and safety at our sessions, we shall not in anyway be liable for any loss or damage arising in any way from our sessions or venues we use. However, nothing in these terms and conditions shall limit the liability of any person for death or personal injury caused by negligence. Any claim against us arising from attendance at one of our sessions must be notified in writing to us within six months from the day of the relevant session and we shall not be liable for any claim notified to us after this time.

In any event, we shall not be liable to you;

a. for any purely economic loss, for consequential or indirect losses or for any loss of profit or opportunity;

b. (where the claim is insured) for any loss which we are unable to recover from any insurer;

c. (where the claim arises as a result of something which was done or not done by a third party) for any loss which we are unable to recover from that third party; and

d. for any loss which is greater than the fee paid by you for the relevant session. In the event that you cause harm, damage, loss or injury to any other person or property during the session, you agree to indemnify us and reimburse us for all claims, losses, damages, expenses (including reasonable legal fees) and any other liability suffered by us as a result of such harm, damage, loss or injury caused by you. We shall not be liable for any loss or theft of your personal possessions and all property left by you in changing rooms, the car park or anywhere else on or in the vicinity of our venue is done so at your own risk.

Refunds & Cancellations

REFUNDS: All swim fees are non-refundable and non-transferable. Should the company have to cancel a session due to ill-health on the part of the management team we will transfer your booking to a future date.

Should the cancellation be for any other reason ‘weather’, ‘act of god’, ‘water quality’, there will be no refunds issued.

If you have to cancel due to ill-health or hospitalisation a credit will be offered to be used at a future date.

 

 

Governing law

English Law shall govern these terms and conditions and you agree that any disputes shall be resolved exclusively by English courts

 

Bookings

1. If you make a booking either verbally or via the booking system, you enter a contract with Attitude swim coaching. Should you cancel your booking with greater than 48hrs notice, there will be nothing to pay.

2. If you cancel less than 24hrs notice you will be required to make good on your payment. No refund will be offered.

3. The exception to this is for medical reasons.

4. In the event of a no show or no attendance no refund shall be offered.

 

If for some reason the session/lesson is canceled by Attitude swim coaching a full refund will be available on request or you may be credited the session/lesson and roll it over to the next week, or block of lessons.

 

Teachers / Coaches

All Attitude swim coaching staff are fully qualified, insured and have a current DBS Disclosure from England and Wales. Attitude swim coaching will endeavour to provide consistency with teacher / coach on a week-to-week basis.

 

If you have any concerns as to the conduct or suitability of one of our teachers /coaches please contact Annie, who will discuss this matter further and attempt to address any concerns you may have.

 

Pool Lessons

These will be invoiced prior to the start of a new block, unless you pay on a week-by-week basis. We operate a rolling block, should you wish to terminate your lessons, please give 14 days' notice. All blocks of lessons should be paid for 7 days prior to the start of that new block.

 

Open Water Coaching (Intro / Coaching)

You can pay online for these sessions otherwise you will be invoiced for these sessions. Payment in full is expected 7 days prior to the session. Cancellations less than 7 days and more than 24 hrs before the session starting will be offered a partial refund minus any administration costs.

 

Adverse weather conditions

Should an outdoor session need to be canceled due to weather, high winds, lightning, or water pollutants, you will be offered an alternative date, credit towards another session or a full refund.

 

Behaviour

In the event of a swimmer refusing to obey the instructions of any Attitude swim coaching staff or behaving in a manner that puts others at risk or causes damage to property, that swimmer shall not be permitted to continue with the session /lesson and will be asked to leave. In such circumstances, Attitude swim coaching has the right to terminate the contract for that and any future bookings. Attitude swim coaching will offer a full refund minus an administration fee.

 

Open water swimmers please read the swimmer's code of conduct before attending any session.

 

Loss or Damage of Belongings

Attitude swim coaching is not responsible for any loss or damage that occurs whilst undertaking a session or lesson. If at the pool, all valuables should be locked in a locker. If at the lake you can ask the lifeguard to look after keys etc, or carry secured in your tow float, worth investing in a non-electronic key for water activities. If at Delph, Annie will happily secure your key in her car.

Cancellation & Refund Policy

Booking Services

Include weekly swims, coached sessions, adventures and courses.

 

Cancellation Policy

For general bookings, weekly swims and coached sessions a minimum 48 hours notice is required to cancel your booking. If booking is cancelled in a shorter timeframe, no refund will be offered. The only exception to this is medical illness or emergency.  

​

Some adventure trips incur bookings expenses and administration costs, for these events the cancellation period for these trips is 3 days.

 

For course bookings a full refund will be offered if requested within 3 weeks of the course starting after that only 50% will be offered, within 7 days of the course starting no refund will be offered. This is beacuse classrooms will have been hired, and course manuals bought, plus administration costs. The only expception is serious illness on production of a doctors letter.​​​
